Maybe the interviewer is also expecting the answer. "It will work very inefficiently". There is two copy by value as in parameters and one copy as return value.

interviewer expecting how the function check the max number...( whether we have thought of operator overloading or not)

It is not going to work as you can not over load turnary (?:) operator.
